Mr. Huffaker joined the Firm in 1999, after graduating from Vanderbilt University with a Bachelor of Engineering degree in Chemical Engineering, and from the University of Alabama School of Law where he served on the Alabama Law Review. He has litigated a wide variety of civil cases with an emphasis in defending complex commercial, product and lender liability lawsuits, and professional malpractice claims. His experience in this area includes litigation of individual cases and mass tort and class action litigation, both at the local and national level.

Mr. Huffaker regularly defends attorneys against claims of professional negligence, and financial institutions in state and federal court against a variety of legal theories, including wrongful foreclosure, breach of contract, fraud and violations of the FDCPA, FCRA, TILA, Regulation Z, CFPB regulations, and bankruptcy stay/discharge.

He also is retained to assist insureds and insurance companies with guidance and representation in insurance coverage disputes. Moreover, being based in Montgomery, Alabama, he is regularly appointed as a Deputy Attorney General by the State of Alabama to represent its interests in a variety of litigation, including contract and Title VII actions.

Mr. Huffaker has managed attorneys in other states handling complex litigation for clients nationwide. He has directly handled complex litigation as counsel in federal or state cases in Alabama, Florida, New Jersey, South Carolina, Tennessee, Kentucky, Mississippi and Washington.

Because Mr. Huffaker is highly respected in the legal community, he has been appointed to numerous prestigious positions of leadership and guidance, including

  • Commissioner, Alabama Securities Commission, Term 2016-2020 (appointed by Governor, confirmed by Senate)
  • Member, ALI Committee to Review and Propose Changes to Article VI of the Constitution of Alabama of 1901, which governs the state judiciary (Appointed by the Alabama Law Institute)
  • Member, Alabama Civil Jury Charge Committee (appointed by Alabama Supreme Court)
  • Member, Alabama State Bar Committee Governing the Unauthorized Practice of Law (appointed by the Alabama State Bar)
  • Officer/Director, Federal Bar Association (M.D. Alabama)

RECENT Practice Highlights

On August 29, 2016, the Eleventh Circuit Court of Appeals affirmed a summary judgment order in favor of a firm client in a multi-million dollar legal malpractice case.  This was a hard-fought victory in a case involving very complex legal issues.

Obtained summary judgment in legal malpractice case against lawyer client in underling mass tort case, argued to Kentucky appellate court and affirmed in May 2010

Obtained summary judgment in legal malpractice case against lawyer client in the Eastern District of Tennessee, argued to and affirmed by the Sixth Circuit Court of Appeals

Arbitrated and tried over 40 cases over the previous 15 years

Handled over 40 appeals over the previous 10 years, including all Alabama state appellate courts, the Eleventh Circuit Court of Appeals, the Kentucky Supreme Court, and the Sixth Circuit Court of Appeals

Handled litigation in several states, including Kentucky, Tennessee, Florida, Washington, New Jersey, South Carolina, and Mississippi
